3. PRODUCTS AND PRICE POLICY

The supplier guarantees that the products are new and that they specify the alternative where applicable, and at the time of delivery they are accompanied by a tax invoice according to the legislation in force.
Products are offered within the limits of available stock. Therefore, SC ORIGINAL TRADITION SRL reserves the right not to honor an order if the product in question is no longer in the current offer on the website and undertakes to frequently update the offer of products on the website, depending on the availability of the products in stock.
The prices shown on the website include VAT (5% or 19% according to the legislation in force), but do not include delivery costs. The delivery costs are displayed in the "Delivery information" section, and in the "Complete the order" section, both the total price of the products (VAT included) and the total price of the order (transportation/delivery costs) will be displayed.
SC ORIGINAL TRADITION SRL undertakes to correctly display prices and information on the characteristics and availability of the products on the website. The images published on the website next to the products are for presentation purposes, and the delivered products may be slightly different from those shown in the images. The website www.myromanianstore.com sells entirely handmade products, but also products whose component parts are handmade. All products are made by Romanian craftsmen, artisans and artists. No two products are identical. Differences or small defects confirm the authenticity of the products sold by my Romanian store and are characteristic of products manufactured by hand (partially or completely). Differences and small defects specific to hand-made products (partially or fully) are not covered by the warranty and are not grounds for return.

4. BILLING AND PAYMENT
Payment can be made in cash upon delivery, by payment order/bank transfer in advance (according to the proforma invoice issued by SC ORIGINAL TRADITION SRL) or by online card after the order is completed.
• Cash on delivery payment
Payment is made in full, in lei, at the amount confirmed and highlighted in the issued invoice, to the commissioner who performs the delivery, at the time of receipt of the package.
• Payment by payment order/bank transfer
This payment will be made in advance to the bank account of SC ORIGINAL TRADITION SRL after confirming the order and issuing a proforma invoice with the value of the products ordered, according to the legislation in force. The tax invoice will be issued after payment confirmation and will be sent to the beneficiary together with the ordered products. The data required to make the payment by bank transfer are:

On the website www.myromanianstore.com online payments can be made with VISA, Master Card, Maestro and Visa Electron cards through the MobilPay payment processor. The money will be withdrawn from the account at the time of completion of the order after filling in the card data and the amount related to the value of the order in the interface of the payment processor. For payments with credit/debit cards issued under the Visa and MasterCard logo (Visa/Visa Electron and Mastercard/Maestro) the 3D Secure system is used. This system ensures online transactions the same level of security as those made at the ATM or in the physical environment, at the merchant. 3D Secure ensures, first of all, that no information related to your card is transferred or stored, these data being directly entered into the Visa and MasterCard systems. In addition, 3D Secure is a system for authenticating the identity of cardholders in the electronic environment. All prices related to the goods presented on www.myromanianstore.com are expressed in lei (RON) and euros (EUR) and include VAT. The exchange rate at which the prices are calculated is 1 EURO = 4.75 RON.
In the case of online payments, my Romanian store is not and cannot be held responsible for any other additional costs borne by the buyer, including but not limited to the currency conversion fees applied by the card issuing bank if the currency of issue has card differs from RON/EURO. Responsibility for this action rests solely with the buyer.

5. DELIVERY AND SHIPPING
The products ordered on www.myromanianstore.com are delivered throughout the country within 24-48 hours after our team sends the confirmation. Deliveries are made by express courier DPD or Urgent Cargus throughout the country, in the localities served by them without paying the fee for additional kilometers. To see if the delivery location is in the standard DPD or Urgent Cargus delivery area, we recommend checking the website www.dpd.ro, respectively www.urgentcargus.ro before placing the order. If the shipping fee exceeds the standard delivery fee charged on our website, the customer will be contacted by an agent to find another shipping solution.

Fragile products are wrapped in bubble wrap to protect them during shipping.
The package will go to the address specified by the buyer when completing the order. It is recommended to indicate an address where the customer can be found on working days between 9 am and 6 pm. Deliveries are made only during this period. If the customer is not found at the mentioned address, within the mutually agreed time interval, the courier will return once more after managing to contact him, after which the order will be returned to the office, the customer bearing the costs of a new deliveries, regardless of the value of the products ordered. ORIGINAL TRADITION will keep the goods ordered for 3 (three) days. After this interval, the order will be cancelled.
Orders are processed and shipped Monday through Friday, excluding public holidays. Orders received after 2pm will be processed and shipped the next day. Orders received after 2pm on Friday will not be processed until Monday next week. The delivery period begins with the receipt of the order confirmation email. my Romanian store is not responsible for unforeseen delays. No deliveries are made to PO boxes or post offices.
SC ORIGINAL TRADITION SRL reserves the right to confirm orders before honoring them by contacting customers. The receipt of the products represents the customer's acceptance that the products have arrived in good condition and correspond quantitatively and qualitatively to what was ordered, and this is done at the time of signing the legal tax documents that accompany the package. The customer is obliged to receive the goods and, if everything is in accordance with the order, to sign the documents of the courier. The number of products and package integrity must be considered. If applicable, it is recommended to report any irregularity or lack of compliance in writing, both in the courier company's documentation and at the contact address hello@myromanianstore.com. If the product received is damaged, it is recommended to return it in its original condition, without using it and without removing the labels. The loss or damage of the products ordered on the website becomes the customer's responsibility once the shipping documents are signed.
SC ORIGINAL TRADITION SRL reserves the right to delay or cancel deliveries of ordered products if they cannot be honored for reasons independent of ORIGINAL TRADITION which include (but are not limited to): fires, explosions, floods, epidemics, strikes, government actions , wars, acts of terrorism, protests, civil disturbances, closed roads or other force majeure impediments according to the customs of Romanian law. If the delivery time will be extended, all affected customers will be notified in advance.
SC ORIGINAL TRADITION SRL reserves the right to stop sending orders to people who have not fulfilled their pecuniary or other obligations towards ORIGINAL TRADITION. Also, the contract will be interpreted and executed in good faith. Any abuse will lead to the termination of any contractual relationship. If, for various reasons, the customer refuses 3 orders or returned products, SC ORIGINAL TRADITION SRL reserves the right to refuse honoring future orders for the same delivery address.
For orders placed outside the European Union (EU), customs duties may be charged. If applicable, payment of these additional charges shall be the responsibility of the buyer. Taxes will be paid upon receipt of goods. It is the customer's responsibility to check the local customs/tax values ​​very carefully before placing an order on the www.myromanianstore.com website and, if applicable, undertake to pay the related tax amounts.

These regulations are brought to the attention of potential participants only through the own website www.myromanianstore.com or through existing accounts on social networks, accounts managed by SC ORIGINAL TRADITION SRL These promotions benefit only orders that strictly comply with the rules displayed on website www.myromanianstore.com. Also, promotions only apply to orders that are registered by the company within the time period specified in the regulation and where the promotion is valid and only within the limit of available stock. SC ORIGINAL TRADITION SRL does not guarantee the availability of products for the promotion in stock. We reserve the right to discontinue or cancel any promotion at any time without any prior notice.

8. WARRANTY OF PRODUCTS
SC ORIGINAL TRADITION SRL undertakes to present all the products on the website www.myromanianstore.com in the most detailed and realistic way possible. However, it is possible that due to different monitor settings, the actual colors may be slightly different. All products on www.myromanianstore.com are made in Romania by Romanian craftsmen or young artists.
The legal guarantee of conformity applies only for lack of conformity, i.e. if the products are found at the time of their delivery to the consumer in one or more of the following situations:
1. They do not correspond to the description made by the seller and do not have the same qualities as the products that the seller presented to the consumer as a sample or model;
2. They do not correspond to any specific purpose requested by the consumer, purpose made known to the seller and accepted by him at the conclusion of the sale-purchase contract;
3. They do not correspond to the purposes for which products of the same type are normally used;
4. Being of the same type, it does not present normal quality and performance parameters that the consumer can reasonably expect, given the nature of the product and the public statements regarding its concrete characteristics made by the seller, the manufacturer or his representative, in particular by advertising or by inscription on the product label.
For any problem, concern or question, the customer will send a notification to the address hello@myromanianstore.com. The term in which SC ORIGINAL TRADITION SRL undertakes to send a written answer is 3 (three) working days.
Important: the guarantee only applies if the buyer provides proof of purchase of the product - presentation of the receipt or tax invoice is mandatory.
Conditions in which the warranty becomes inapplicable or void:
• moral wear and tear and normal physical wear and tear of the product;
• discoloration of the product or some component parts following prolonged exposure to severe environmental factors (sun or another strong source of heat, humidity, rain, snow, etc.);
• damage to the product following calamities (fire, earthquake, flood, lightning, etc.), accidents, arson or theft;
• defects caused by transport, handling and storage in improper conditions (excessive temperature and humidity, thermal shocks - hot/cold variations, immersion, etc.);
• defects caused by improper, abusive, incorrect, modified use of the product and/or in improper conditions other than those for which it was tested and designed;
• intervention, repair or modification made by unauthorized persons, including painting the product;
• damage to the product caused, voluntarily or involuntarily, by mechanical shocks (breaking, hanging, hitting, scratching, etc.), pets, rodents and other pests;
• faulty maintenance (cleaning using inappropriate methods or products).
The following are not considered manufacturing defects, therefore they are not covered by the warranty:
• particularities of handmade products: ribs, small color differences, characteristic marks and irregularities - precisely this shows the authenticity and quality of the materials from which the products sold by my Romanian store are made;
• small irregularities and imperfections of products or parts of handmade products.

9. RETURN POLICY

Law OG 34/2014 allows the return of products purchased online within 14 calendar days from the date of their purchase without penalties and without citing a reason. Thus, if you want to return the ordered products, we will in turn return the value of the products, less the delivery fees. The value of the returned products is transferred immediately after we take possession of these products and ensure their integrity. Products must be intact and unused for return. You can notify us both by email and by phone of your desire to partially or totally return an order. We will respond within a maximum of 3 working days.
Refunds will be made within 14 days from the date of acceptance of the return by Original Tradition SRL. In order to accept the return of the products, they must be in the same condition in which they were delivered to you (have the original tags, not be worn or damaged). You must also maintain the integrity of the accompanying documents. In order to be able to resolve your refund request as quickly as possible, we recommend that you refund the products via a courier company (eg: DPD, FAN Courier, Urgent-Cargus, Nemo Express, GLS), not via the Romanian Post.
You can opt to replace the returned product with another available in stock. If you want to replace the returned product with another available in stock, the return costs will be borne by you, and those with the delivery of the new product will be borne by us. Replacement with a product with a higher value requires payment of the difference by refund upon receipt of the parcel. Reimbursement of the value of the returned product will be made within 14 calendar days at most by bank transfer to the IBAN account specified in the return form.
If you received a product other than the one you ordered or a product with defects, contact the my Romanian store team within 72 hours (at phone number 004-031.422.02.59 or directly at our headquarters in Strada Episcipiei no. 6, sector 1, Bucharest) to complain about this situation and we will ensure that the product is replaced with a new product or that the money will be refunded as soon as possible. The return and shipping costs for the replacement product, if applicable, are borne by my Romanian store. For products whose parcels show visible damage upon receipt by courier, we recommend that you refuse to receive them.
Careful! We do not accept returns with a refund!
If the order was sent to a destination outside the European Union (EU), any customs duties incurred by the customer will not be reimbursed by my Romanian store. However, you may be able to recover the amounts of tax applied at customs - please contact your local customs office for more information.

10. RIGHT OF WITHDRAWAL
In accordance with the Emergency Ordinance no. 34/2014, the customer has the right to withdraw from this contract, without specifying the reasons, within 14 calendar days. The withdrawal period expires after 14 days. To exercise your right of withdrawal you must inform us of your decision to withdraw from this contract using an unequivocal statement, for example an email.
If the customer decides to withdraw from this contract, SC ORIGINAL TRADITION SRL will refund any amount received from the customer (with the exception of delivery costs already paid) and no later than 14 calendar days from the date on which we inform you of your decision to withdraw from this contract. We will make this refund using the same payment method as used for the original transaction, unless you have expressly agreed to a different refund method; in any case, you will not be charged commissions from my Romanian store as a result of such a refund. The refund is made within 7 days from the date we receive the products back. Products customized according to the customer's requirements, products with physical changes, bumps, chips, scratches, shocks are not accepted for return.

11. QUALITY OF HOSTING SERVICES, LINKS TO OTHER SITES, FUNCTIONING ERRORS

SC ORIGINAL TRADITION SRL cannot be held responsible for any errors that appear on the site, regardless of the reasons for their appearance, including changes to the site, settings or updates of programmed scripts. ORIGINAL TRADITION cannot be held responsible for errors that occur due to the use of certain browsers to visit the www.myromanianstore.com website. Any other problem caused by the products and services presented on www.myromanianstore.com and which is not already covered by any article in this document, will be resolved amicably within 30 working days from the date of notification of the problems in writing to the user at the email address hello@myromanianstore.com.
In the event that it was not possible to resolve the conflict amicably, the competence rests with the Romanian courts or an alternative dispute resolution body agreed by both parties.
By agreeing to these "Terms and conditions" of using the website www.myromanianstore.com, the customer fully assumes the consequences arising from using the website under these conditions. The maximum amount of damages that can be paid by SC ORIGINAL TRADITION SRL against any customer is the amount collected by ORIGINAL TRADITION from this customer.
